Healthy Baked Cinnamon Apples respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), Healthy Baked Cinnamon Apples will respond expeditiously to claims of copyright infringement committed using the Healthy Baked Cinnamon Apples website or other online network accessible through a mobile device or other type of device (the "Site") if such claims are reported to Healthy Baked Cinnamon Apples's Designated Copyright Agent identified in the sample notice below.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Healthy Baked Cinnamon Apples's Designated Copyright Agent.

Upon receipt of the Notice as described below, Healthy Baked Cinnamon Apples will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Site.

  4. Include both of the following statements in the body of the Notice:
    • "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
    • "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
  5. Provide your full legal name and your electronic or physical signature.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with Healthy Baked Cinnamon Apples by submitting a written notification to our Designated Copyright Agent, which includes the following (please consult your legal counsel or see 17 U.S.C. Section 512(g)(3) to confirm these requirements):

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., URLs).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Healthy Baked Cinnamon Apples may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
  • Your physical or electronic signature.

Please send the Counter-Notice to Healthy Baked Cinnamon Apples's Designated Copyright Agent at the contact information provided above. Upon receipt of a valid counter-notification, Healthy Baked Cinnamon Apples will forward it to the complaining party who submitted the original DMCA notice. The complaining party will then have 10 business days to inform Healthy Baked Cinnamon Apples that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on Healthy Baked Cinnamon Apples's Site. If we do not receive such notification within 10 business days, we may, in our sole discretion, restore the material.
